Sales Terms

These Sales Terms (the "Sales Terms") govern the paid offers available on Monsieur Chouchou (the "Service"), operated by Moonstack. They supplement the Terms of Service.

The Service distinguishes two kinds of offers:

  • offers provided by Moonstack, in particular the subscription granting access to the platform tools;
  • offers provided by third-party creators (subscription to their exclusive content, one-off recipe purchases), for which Moonstack acts solely as an intermediary.

Some features of the Service are currently free. These Sales Terms apply as soon as a paid offer is subscribed to or purchased.

Article 1 — Parties and Moonstack's role

1.1 Moonstack offers

For the offers it provides in its own name (in particular the tools subscription), Moonstack is the seller. The sales contract is concluded directly between you and:

1.2 Creator offers

For offers provided by a creator (subscription to their exclusive content, one-off recipe purchases), the seller is the creator themselves, identified on their page. The sales contract is concluded between you and that creator.

Moonstack is not a party to that contract: it acts solely as a technical intermediary and collection agent, in the name and on behalf of the creator, through its payment provider. The creator remains solely responsible for their content, the conformity of their offer, its delivery, and the related complaints.

Article 2 — Offers and prices

Paid offers may take the following forms:

  • a tools subscription for the platform, sold by Moonstack;
  • a subscription to a creator's exclusive content, sold by that creator;
  • the one-off purchase of recipes or content, sold by their creator.

Prices are shown in euros, inclusive of all taxes, and clearly displayed before the order is confirmed. The applicable price is the one in force at the time of the order.

Prices may be changed at any time. Any change has no effect on orders already confirmed nor, for an ongoing subscription, on the period already paid for.

Article 3 — Order process

Subscribing to a paid offer requires you to:

  • have an account on the Service;
  • select the desired offer;
  • review the details and total price before confirming;
  • accept these Sales Terms and proceed with payment.

Confirming the order constitutes acceptance of these Sales Terms and forms the sales contract with the relevant seller (Moonstack or the creator). A summary is sent to you by email.

Article 4 — Payment

Payment is made online, by bank card, through our secure payment provider. For creator offers, collection is carried out by that provider on behalf of the creator. Bank details are transmitted directly to the provider and are neither processed nor stored by Moonstack.

The order is definitively recorded only after payment is confirmed. If payment is declined, the order is automatically cancelled.

Article 5 — Supply of content

Offers relate to digital content supplied online. Access is opened immediately after payment confirmation, or on the subscription start date, with no physical medium or delivery.

Article 6 — Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, you generally have a period of 14 days to exercise your right of withdrawal, without having to justify your decision.

Exception — digital content. By requesting immediate access to the content, you acknowledge that its performance begins before the end of the withdrawal period and you expressly waive that right, in accordance with Article L221-28, 13° of the French Consumer Code. No refund is due once the content has been made accessible.

For an offer sold by a creator, this right is exercised against the creator, who is the seller. You may write to contact@monsieurchouchou.com and we will relay your request.

Article 7 — Subscriptions: duration and cancellation

Subscriptions are taken out for the duration indicated at the time of the order (for example monthly) and renew by tacit renewal for identical periods, unless cancelled.

You can cancel your subscription at any time and easily, from your account or by contacting us. Cancellation takes effect at the end of the current period: you keep access until that date, with no further charge.

Article 8 — Creator offers

A creator who provides a paid offer warrants that they hold all the rights necessary over their content and comply with applicable regulations. As the seller, they are solely responsible for the conformity of their offer, its delivery, and the handling of related complaints.

This feature is currently in restricted access (beta). The detailed terms applicable to creators (remuneration, payouts, responsibilities) are set out in specific conditions communicated to them.

Article 9 — Legal guarantees

You benefit from the legal guarantees provided for by the French Consumer Code, in particular the guarantee of conformity applicable to digital content and services (Articles L224-25-1 et seq.), enforceable against the seller of the offer. To invoke them, contact contact@monsieurchouchou.com.

Article 10 — Complaints and mediation

For any complaint, first contact our customer service at contact@monsieurchouchou.com. For an offer sold by a creator, the complaint is forwarded to the creator concerned.

In accordance with Articles L612-1 et seq. of the French Consumer Code, consumers may use a consumer mediator free of charge to reach an amicable resolution of a dispute.

Article 11 — Personal data

The processing of your data in connection with a purchase is described in our Privacy Policy.

Article 12 — Governing law and disputes

These Sales Terms are governed by French law. In case of dispute, an amicable solution will be sought before any legal action.
